Last Will and Testament of Harry Prather

In the name of God, Amen: I, Harry Prather of Washington County State of Maryland, being of sound, disposing mind, memory and understanding wishing to settle all my worldly affairs do therefore make and ordain this my last will and Testament in manner and form following, to wit: - Imprimis, I give and devise to my Wife Louisa, for and during her natural life, all my lands together with all the rights and privileges thereunto belonging, with all the rents issues and profits thereof.

Item. after the death of my wife Louisa, I give and devise to David Chatwell alias David Moore and his heirs and assigns forever a small tract of Land called Mountain Lot Together with the resurves on it called "Saline Grove" but if he should die without issue I then in that case give and devise the said Land to my wife Louisa and her heirs and assigns for ever, and if my wife Louisa should die without issue or without making sale or a will of the same I then in that case give and devise the said Land to Perry Prather and Samuel Prather the sons of my late brother Samuel Prather and their heirs and assigns forever.

Item. after the death of my wife Louisa I give and devise to Perry Prather and samuel Prather sons of my late brother Samuel Prather and their heirs and assigns forever (as tenants in common & not as joint tenants) all the residue of my Land, but if either of them should die without Legal issue. In that case I bequeath and devise the whole of said Land to the survivor his heirs and assigns forever.

Item. After the payment of my just debts and funeral charges I give and bequeath all the residue of my estate real and personal to my wife Louisa and her heirs and assigns forever.

Lastly. I do hereby constitute and appoint my wife Louisa Executrix and Perry Prather Executor of this my last will and testament, revoking all other wills made and executed heretofore. In testimony whereof I have hereunto set my hand and affixed my seal this Third day of October in the year of Our Lord one thousand eight hundred and twenty seven.

Signed, sealed and declared by the testator as and for his last Will and Testament in the presence of us, who at his request, in his presence, and in the presence of each other have subscribed our names as witnesses thereto

Washington County, to wit:

On this 14th day of April 1829 came Louisa Prather & Perry Prather and made oath that his is the true and whole will of Harry Prather late of Washington County dec'd. that hath come to their hands or possession and that they do not know nor have heard of any other.

At the same time came Isaac Nesbit & John D. Ridenour and severally made oath that they saw the Testator herein named sign and seal this will and testament, that at the time of his so doing he was to the best of their apprehensions of sound and disposing mind, memory and understanding, that they subscribed their names as witnesses to this will in the presence and at the request of the testator, and in the presence of each other, and that they saw the other subscribing witness do the same.
